Terms and conditions of the BY MY LOVE online store

The store’s website www.bymylove.pl is running by Małgorzata Gołębiowska, entered into the Central Register and Information on Economic Activity of the Republic of Poland by the Minister of Development and Finance.

I. GENERAL REGULATIONS

The online store is open 7 days a week, 24 hours a day.

These regulations determine the rules of using the online store, including the rules of concluding sales contract for goods available in the online store, the rules of executing contracts and the rules of reporting complaints.

We are selling brand new clothes and accessories.

Every adult customer or person over 13 years of age (with the consent of the legal representative) is authorized to use the online store.

The customer who uses the online store is obliged to:

1) - Using the online store according to the regulations and the previsions of these regulations;

2) - Using the online store according to the good manners and respect for other people;

3) - Not sending spam or other incorrect messages;

4) - Using the online store only for personal purposes.

II. REGISTRATION

1. By My Love is selling clothes on the website www.bymylove.pl

2. The service consists of logging in, placing an order, selecting the payment method or confirming the order.

3. Registration in the online store is free and voluntary.

4. Every costumer can browse the online store’s offer and place the order without registering. Registering allows you to add products to your ,,favorite’’ and recommend them to friends, check your order or order’s status.

5. Registering rely on pressing the tab ,,Login/Registration’’ or registering an account during placing an order via the online store.

6. Registration rely on completing the form and providing your email address and password. In order to register, it is necessary to accept the regulations and consent to the processing of personal data.

7. After the registration, you should confirm your data by pressing the button ,,Register’’. To your email address, it will be sent a message confirming the registration of the customer account.

Running an account is free of charge for an indefinite period of time.

8. During the next registration, the customer can use the previously provided email address and password.

9. The customer may contract out at any time without giving a reason or incurring costs to the email address or in writing way to the postal address. The customer may also request the deletion of the customer’s account.

10. By My Love can also contract out with a 14-day notice period in special cases when the customer violates the law or the provisions of the regulation or sends illegal messages, including spam.

11. Notice of termination of a contract by BY MY LOVE takes place by sending the notice by e-mail to the indicated e-mail address or in writing via post.

12. Notice of termination of a contract by both sides will result in blocking the account and deleting the account form the online store.

III. PLACING ORDERS

1. The customer can purchase goods by placing an order 24 hours a day and 7 days a week after accepting the regulations.

2. To place an order you need to complete the order, choose the method and place of delivery, the method of payment, fill out the form and confirm ,,Confirm purchase’’.

3. The customer confirms the order by using the ,,Cart’’, using ,,Add to cart’’and then ,,Checkout’’.

4. The customer selects the method of delivery, the method of payment and fills out the order form. In the order form, the customer indicates - the name, the surname, the address, the telephone number and recipient’s details, if the goods have to be delivered to a different address.

5. The goods are delivered within the country and abroad after agreement with BY MY LOVE via email address - biuro.bymylove@onet.pl

6. During the order, the customer receives full information about the value of the order, including delivery costs.

7. During the order processing, the customer can modify the order.

8. The order constitutes an offer for sale and after receiving the order, BY MY LOVE sends confirmation of acceptance of the order for processing.

9. The service provided by BY MY LOVE is a one-time service and it is necessary to place another order with the next sales offer.

10. The customer has the right to cancel the order no later than the next day after payment.

IV. PRICES OF GOODS

1. The prices of goods are gross, i.e. they include value added tax (VAT).

2. The prices of goods do not include the costs of delivering the goods.

3. The prices given on the website are apply only for placing an order via the online store and do not apply to goods placed in the BY MY LOVE store.

4. BY MY LOVE reserves the right to change prices - the change can only apply to the next order.

V. METHOD OF PAYMENT

1. The customer can pay in the form of cash on delivery upon receipt of the goods.

2. The customer who has chosen the payment in cash on delivery should pay upon receipt of the goods - otherwise the courier will not handed the package over to the customer.

3. The customer who placed the order with paymnet in advance should make the payment within a few hours on the same day. If the payment in not made, the contract will not be concluded.

4. The customer can make a payment by transfer to the bank account indicated by BY MY LOVE.

VI. REALIZATION OF ORDERS

1. The goods are delivered in the Poland via a courier company, the Inpost parcel locker system or directly at the BY MY LOVE store.

2. The goods are delivered on working days and the delivery is paid/non - gratuitous.

3. The costs of delivering the goods are always indicated during the realization of the order.

4. The order processing time is 1-5 working days according to the regulations of courier company.

5. The goods ordered to the store will be available within 3 days. The deadline may be extended after consultation with BY MY LOVE.

6. The goods are delivered to the customer with a receipt or invoice (at the customer’s request).

7. If you choose to pay by bank transfer, the shipment will take place after the payment has been credited to our bank account.

VII. RIGHT TO CONTRACT OUT

1. The customer can contract out within 14 days without giving a reason and without incurring additional costs.

2. The 14-day period is counted until the day, the goods are received by the customer or handed over to the person indicated by the customer.

3. The customer can contract out by submitting a declaration of withdrawal from the contract.

4. The customer should return the goods at yourself’s cost immediately, i.e. within a maximum of 14 days and the delivered goods should be returned undamaged with a label and without traces of use and properly traced.

5. In the event of contract out, BY MY LOVE will refund all payments after deducting any shipping costs if the product meets the criteria of point 4.

6. The customer is not entitled to contract out in the following cases:

1) - If the service was performed with the consent of the customer;

2) - If the product was a service produced according to the client’s individual arrangements to satisfy his needs;

3) - In relation to contracts in which the price depends on fluctuations in the financial market, over which BY MY LOVE has no control and which may occur before the deadline for contract out.

4. The goods purchased from SALE are not refundable or exchangeable.

VIII. COMPLAINTS

1. BY MY LOVE delivers goods without physical and legal defects.

2. Complaints should be submitted in writing to the following address: BY MY LOVE ul. Powstańców Śląskich 80 B, 01-466 Warszawa with the note: ,,Complaint’’ within 14 days from the date of receipt of the goods. Contact regarding returns - 511 355 060 or biuro.bymylove@onet.pl during the working hours of the Customer Service Office. The returned goods should be new, properly secured and without traces of use.

3. The complaint should include - the name, the surname, the address, the telephone number, the email address, the date of purchase the good, the description of the defeat and the subject of the complaint. To the complaint you must attach the proof of purchase (a receipt) and a correctly completed form. A compliant can not be submitted if the goods were purchased in the stationary store. If the returned goods do not meet the conditions, it will be sent back to customer at the customer’s cost.

4. The complaint will be considered immediately, no later than within 14 days from the date of receipt of the complaint.

5. In the event of missing complaints, BY MY LOVE will ask the customer to complete the data. After that, the 14-days period for responding to complaints will be counted from the date of sending the completed data.

6. We do not accept packages sent via car on delivery or parcel lockers.

IX. ASSERTION OF CLAIMS

Legal disputes between the client and BY MY LOVE will be resolved by a mediator agreed between the parties; in the absence of consent to mediation, the disputes will be resolved by the regional court for Warszawa-Wola in Warsaw.

X. NEWSLETTER

1. The customer can consent to receiving the Newsletter, which will be sent only to customers who have agreed to it.

2. The Newsletter sent to the customer contains free information about the BY MY LOVE offer, new products, promotions and other offers.

3. The customer may unsubscribe from the Newsletter at any time by selecting the button:
,,Unsubscribing from the Newsletter’’.

XI. INFORMATION REGARDING PERSONAL DATA

1. The customer’s personal data are processed and protected by BY MY LOVE which is the personal data administrator. From May 25, 2018, it will be possible to contact the data protection officer via the following address: biuro.bymylove@onet.pl

2. Personal data will be processed in particular: taking action before concluding a contract at the person’s request or performing a contract which the party is a person who the data related to or filling the legal obligation imposed on the Administrator.

3. Additionally, personal data will be processed with the customer’s consent for the purpose of marketing goods and services, organizing and conducting competitions and other marketing campaigns, claiming or securing claims, conducting internal analyses, including the customer’s preferences or interests, e.g. providing the customer with information about proposed changes contract, accepting complaints and responding to them to the indicated email address.

4. Personal data will be stored during the term of the contract and after contract out for the purpose of marketing until the customer does not object.

5. After the customer’s registration and placing the order, the customer’s personal data are protected according to the regulations, including the act of August 29, 1997 on the protection of personal data.

6. After the customer’s consent to sending the Newsletter, the customer’s data is used for marketing purposes.

7. Personal data is not made available to other persons and is not sens abroad.

8. The customer has the right to access to his or her personal data, to modify the data, to limit the data processing and to request the removal of data from the BY MY LOVE database and to cancel a consent at any time and to lodge a complaint with the Polish supervisory authority.

9. Cookies are used in the system with the customer's consent. The customer may limit or disable cookies at any time.

10. Regarding to the protection of personal data apply the provisions, including Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on protection of natural person with regard to the processing of personal data on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation).

XII. FINAL PROVISIONS

1. Price lists of BY MY LOVE goods constitute a sales offer - BY MY LOVE reserves the right to change the price.

2. BY MY LOVE bases its activities on generally applicable provisions and the content of these regulations.

3. The The Regulations are available on the website www.bymylove.pl.

4. BY MY LOVE reserves the right to change the regulations.

5. The contract withdrawal form is an annex to the regulations.

6. BY MY LOVE prohibits copying photos presented in the offer.
